Better Golf Clubs
These Terms of Service (“Terms”) apply when you use the Better Golf Clubs website and services at www.bettergolfclubs.shop (the “Site”), operated by Better Golf Clubs Pty Ltd (ABN 37 831 703 493), trading as Better Golf Clubs. Our store is powered by Shopify. By using the Site, you agree to these Terms and our Privacy Policy. If you don’t agree, please don’t use the Site.
You must be at least 18 to buy from us. You’re responsible for keeping your account details secure and for activity on your account, and for giving us accurate, current information when you order. You may not resell, transfer or misuse your account.
We sell pre-owned and new golf clubs. Because our stock is largely second-hand, every club is inspected and given a condition grade, described honestly in the listing. Screens vary, so colours and finish may look slightly different in person. We aim for every description and grade to be accurate; if a club ever arrives not as described, you’re covered by our Returns & Refunds Policy and the Australian Consumer Law. We may update or discontinue products and limit quantities at our discretion.
When you place an order you’re making an offer to buy. Your order is accepted once we confirm it and process your payment. Occasionally we may need to decline or cancel an order — for example, if an item is out of stock or a listing contained an error — and if we do, we’ll contact you and refund any payment in full. Purchases are for your personal use, not commercial resale or export.
Prices are in Australian dollars and may change at any time; the price you pay is the one shown at checkout and confirmed in your order email. You confirm you’re authorised to use your chosen payment method. Promotions may have their own terms, which apply if they conflict with these Terms.
Delivery is covered by our Shipping & Delivery Policy, and returns and refunds by our Returns & Refunds Policy. Both form part of these Terms.
The content on the Site — text, images, graphics, logos, reviews and its arrangement — belongs to Better Golf Clubs or its licensors and is protected by Australian and international law. You may use the Site for your own personal, non-commercial use only. Don’t copy, reproduce, republish or resell any part of it without our written permission. “Better Golf Clubs” and our logo are our trademarks and may not be used without our consent.
Please use the Site lawfully. Don’t use it to break the law, infringe anyone’s rights, harass or abuse others, post false or misleading information, spam, upload malicious code, scrape or harvest data, or interfere with the Site’s security or operation. We may suspend or close accounts that breach these Terms.
If you submit a review, photo, idea or other content, you grant us a non-exclusive, royalty-free licence to use, display and reproduce it in connection with our business, and you confirm it’s yours to share and doesn’t breach anyone’s rights or any law. We may remove content we consider unlawful or objectionable, but we’re not obliged to monitor it.
The Site may link to or use third-party websites and tools (including Shopify features). We don’t control these and aren’t responsible for their content, products or practices — your use of them is at your own risk and subject to their terms.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where we’re permitted to limit our liability, our liability for a failure to meet a consumer guarantee is limited, at our option, to replacing the goods, supplying equivalent goods, or refunding the price. Otherwise, and to the extent the law allows, we’re not liable for indirect or consequential loss, and the Site and its content are provided on an “as is” basis. Because Shopify hosts our store, any sale is directly with Better Golf Clubs, not Shopify, and you release Shopify from claims arising from your purchases with us.
How we handle your personal information is set out in our Privacy Policy. Because the Site runs on Shopify, some information is also processed by Shopify under its own privacy terms.
We may update these Terms by posting the current version on this page; material changes take effect as notified. These Terms are governed by the laws of Queensland, Australia, and you and we submit to the courts of Queensland. If any part is found unenforceable, the rest still applies. Questions?
